1Acceptance and definitions

By using mytool.om (the "Site") or any of its tools, creating an account, or subscribing to My Tool Plus, you confirm that you have read, understood and agree to be bound by these Terms & Conditions. If you do not agree with any part of them, you must stop using the Site.

• "We", "us" or the "Site": mytool.om and its operators.
• "User" or "you": any natural or legal person using the Site or any of its services.
• "Service": the Site's free tools and the paid tools included in My Tool Plus, such as surveys, exams, online elections, the CV builder and the to-do list, and any tools added later.
• "Subscription": the paid My Tool Plus subscription, on a monthly or yearly plan.
• "Content": anything a user creates, uploads or collects through the Service, such as questions, answers, data, images, files and links.

2The Service and your account

1. The Service is provided as it currently stands. We may develop it, change its features, add new tools or discontinue some of them at any time.
2. You are responsible for the accuracy of your account details, for keeping your sign-in credentials confidential, and for all activity under your account.
3. You must have the legal capacity to enter into a contract. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these terms on its behalf.
4. A subscription is personal and tied to the account. It may not be sold, shared or transferred to anyone else.

3Subscription and online payment

1. My Tool Plus is offered on a monthly or yearly plan at the prices shown on the subscription page at the time of payment, in Omani Rials.
2. All payments are made online through the Thawani Pay payment gateway. The Site never sees or stores your card details, and the payment is also subject to the terms of the payment gateway and of your card issuer.
3. Your subscription is activated, or its period extended, as soon as the payment gateway confirms that the payment succeeded. Returning to the Site from the payment page is not, by itself, proof of payment.
4. If you already have an active subscription, the new period is added to the end of the current one.
5. You are responsible for the accuracy of your payment details, for having sufficient funds, and for any fees or charges imposed by your card issuer.
6. We may change prices or plans at any time. A change never applies to a period you have already paid for; it applies from the next renewal after it is announced.
7. You may not proceed to payment or to the payment page without first expressly agreeing to these Terms & Conditions.

4Auto-renewal

1. When you choose "Renew my subscription automatically", you authorise us to charge the price of your chosen plan to the card saved with the payment gateway about one day before your subscription ends, and for each following period, until you turn renewal off.
2. You can turn auto-renewal off or remove the saved card at any time from the My Tool Plus page. Turning it off applies only to future charges; it does not reverse a charge that has already been made.
3. If your bank asks you to confirm a charge, the renewal completes only after you confirm it. If a charge fails, we may retry a limited number of times; if payment is not made, your subscription ends on its end date.
4. It is your responsibility to turn auto-renewal off before the charge date if you do not wish to continue. Amounts charged by auto-renewal are non-refundable under the next section.

5No-refund policy

This includes, without limitation:

• Monthly and yearly subscriptions, including any unused remaining period.
• Amounts charged by auto-renewal that was not turned off before the charge date.
• Not using, or only partly using, the Service; the Service not suiting your needs; or changing your mind after subscribing.
• Cancelling your subscription or deleting your account.
• Suspension, restriction or termination of your account by us because of a breach of these terms.
• Changes to the Service's features or tools, or the discontinuation of a particular tool.

The sole exception is a charge that, after verification, is shown to be a duplicate charge for the same transaction caused by a technical error. Only the duplicated amount is returned, by the method the payment gateway allows, and it must be reported within 14 days of the charge.

This policy does not affect any right that cannot be waived under the laws in force in the Sultanate of Oman.

6Cancelling the Service

1. You can cancel your subscription at any time by turning off auto-renewal. Your subscription stays active until the end of the period you paid for, then ends without renewal.
2. Cancelling does not entitle you to any refund, including for the remaining period of the subscription.
3. When the subscription ends, you can no longer use the paid tools or create new content in them. Earlier content may remain stored for a reasonable time, but we have no obligation to keep it and are not responsible for its loss. We recommend exporting your data before your subscription ends.
4. We may suspend or terminate your account, or end your subscription, immediately and without prior notice if you breach these terms or misuse the Service, without any refund and without prejudice to our other legal rights.

7Acceptable use

You must use the Service for lawful purposes only. You must not, among other things:

• Use the Service for any activity that breaches the laws and regulations in force in the Sultanate of Oman, public morals, or the rights of others.
• Collect personal data from others, through surveys, exams, elections or otherwise, without their knowledge and consent or a lawful basis.
• Commit fraud, mislead, impersonate any person or organisation, or create forms designed to steal sign-in or financial details.
• Manipulate the results of elections, surveys or exams, or present them as official without lawful standing.
• Publish content that is offensive, defamatory, inciting, racist, or that infringes intellectual property rights.
• Send unsolicited messages, attempt to hack, disrupt or overload the Site, or use automated tools without permission.

8Disclaimer

1. The Service is provided "as is" and "as available", without any express or implied warranties, including warranties of fitness for a particular purpose, accuracy, continuity, or freedom from errors, interruptions or viruses.
2. We do not guarantee that the Service will meet your requirements, or that the results, analyses or files it produces (such as reports, election results or CV files) are accurate, complete or acceptable to any party.
3. You alone are responsible for the content you create, publish or collect through the Service, for its lawfulness and accuracy, for obtaining the consent of the people whose data you collect, and for how you use that data.
4. Election, survey and exam results produced through the Site are supporting tools only. They have no official standing except as adopted by the organising body under its own rules, and that body alone is responsible for its procedures and results.
5. We are not responsible for any interruption, delay or fault caused by the payment gateway, banks, hosting or telecom providers, or any circumstance beyond our control.
6. The Service may include links to, or services from, third parties; we are not responsible for their content or policies.

9No liability for misuse

1. The Site does not review content before it is published and has no obligation to monitor it. The presence of content on the Service does not mean the Site endorses or approves it.
2. We may, but are not obliged to, remove any content or disable any link, survey, election or account that we consider unlawful or abusive, without prior notice and without any refund.
3. You agree to indemnify and hold us harmless from any claims, damages, losses or costs, including legal fees, arising from your use of the Service, your content, or your breach of these terms, the law or the rights of others.
4. We cooperate with the competent authorities when required by law, and may disclose account data relevant to any violation.

10Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, consequential, incidental or special damages, including loss of data, profits, opportunities or reputation, arising from the use of, or inability to use, the Service. In all cases, our total liability shall not exceed the amount you actually paid for the subscription during the three months before the event giving rise to the claim.

11Intellectual property

All rights in the Site, its design, logo, tools, templates and software belong to mytool.om, and they may not be copied or reused commercially without written permission. You keep your rights in your content, and grant us a limited licence to host and process it as needed to provide the Service.

12Changes to these terms

We may change these terms at any time. The updated version will be published on this page with its effective date. Continuing to use the Service or renewing your subscription after a change means you accept it. We may ask you to agree to the terms again before any later payment.

13Governing law

These terms are governed by and interpreted in accordance with the laws of the Sultanate of Oman, and the courts of the Sultanate of Oman have jurisdiction over any dispute arising from them. If the Arabic and English texts differ, the Arabic text prevails.
